Welcome to Irish Artmart. These Terms & Conditions govern the use of irishartmart.ie and the services made available through the Irish Artmart marketplace.

Irish Artmart provides an online platform where independent artists can create storefronts, list artwork and connect with buyers. Buyers can browse and purchase artwork, make offers, request commissions and participate in online auctions where available.

By creating an account, purchasing or selling through Irish Artmart, placing an auction bid or otherwise using services that require acceptance of these terms, you agree to these Terms & Conditions.

1. About Irish Artmart

Irish Artmart operates an online art marketplace connecting independent artists and sellers with buyers and collectors in Ireland and elsewhere.

Unless expressly stated otherwise, artwork displayed on Irish Artmart is offered for sale by the individual artist or seller identified on the relevant artwork page.

Irish Artmart provides the marketplace technology, checkout, payment infrastructure and other supporting services. The artist remains responsible for their artwork, listing information, fulfilment, shipping and obligations to the buyer that arise from the sale.

The Artist Is the Seller

When you purchase an artwork through an Irish Artmart artist store, the sale is generally between you and the artist or seller shown on the artwork listing.

Irish Artmart facilitates the marketplace, payment and associated platform services but does not become the creator, owner or seller of an artist's artwork merely because the transaction takes place through Irish Artmart.

Nothing in these terms removes any responsibility Irish Artmart itself has under applicable law.

2. Using Irish Artmart

You may browse Irish Artmart without creating an account. Certain features require registration, and purchases may also be available through guest checkout where offered.

You must be at least 18 years old and legally capable of entering into a binding contract to:

open or operate an artist/vendor account;
purchase where a legally binding contract is entered into;
place bids in an Irish Artmart auction;
enter into an artist subscription; or
use another feature that creates a legally binding obligation.

You must provide accurate and current information and must not impersonate another person or use Irish Artmart for fraudulent, unlawful or misleading purposes.

3. Accounts & Security

Where you create an account, you are responsible for maintaining the security of your login details and for activity carried out through your account.

You must notify Irish Artmart as soon as reasonably possible if you believe your account has been accessed without authorisation.

Irish Artmart will never ask you to disclose your account password by email.

We may restrict, suspend or terminate an account where we reasonably believe it has been compromised, used fraudulently or used in breach of these Terms.

4. Buying Artwork

Buyers are responsible for reviewing the artwork listing, dimensions, medium, framing information, shipping terms, seller information and other relevant details before completing a purchase.

Artwork images are intended to represent the work as accurately as reasonably possible. Colours and appearance may vary slightly depending on photography, lighting, screens and devices.

An order is subject to availability, successful payment and any checks reasonably required to protect buyers, artists or the marketplace.

If an artwork has become unavailable before an order can be fulfilled, the buyer will be informed and any payment due to be refunded will be handled accordingly.

5. Artist & Seller Responsibilities

Artists using Irish Artmart operate their stores independently and are responsible for the goods they offer for sale.

An artist must:

only list artwork they are entitled to sell;
provide accurate titles, descriptions, dimensions, media, images and pricing;
keep availability and inventory information reasonably current;
not misrepresent an artwork, its origin, authorship or condition;
identify the nature of the work accurately, including whether it is an original, print, reproduction or digitally created work;
comply with Irish Artmart's Artwork Quality & Authenticity standards when submitting new listings;
package artwork appropriately for delivery;
dispatch orders within the stated or agreed timeframe;
provide tracking information where appropriate;
communicate reasonably with buyers regarding orders;
comply with applicable consumer, tax and trading laws;
deal appropriately with damaged, incorrect or non-conforming goods; and
keep their store policies accurate and lawful.

Artwork sold elsewhere should be removed from sale or marked as unavailable on Irish Artmart as soon as reasonably possible.

6. Artist Status & Consumer Rights

Artists using Irish Artmart may operate professionally as traders, or in some circumstances may sell in a private or non-trader capacity.

Artists must provide accurate information about their trading status where Irish Artmart requests it and must keep that information up to date.

Consumer protection rights may differ depending on whether the seller is acting as a trader.

An artist's own store policy cannot exclude or reduce statutory rights that apply to a buyer under Irish or European Union consumer protection law.

7. Returns, Cancellations & Consumer Rights

Individual artists may publish their own shipping and return policies. Those policies apply only to the extent that they are consistent with applicable law.

Purchases from a trader

Where a buyer is a consumer and the artist is acting as a trader, statutory consumer rights may apply.

For many online purchases, consumers have a legal right to cancel the contract within 14 days after receiving the goods without giving a reason, subject to the exceptions provided by law.

Where the right of cancellation applies, the buyer must notify the seller within the applicable cancellation period and return the goods in accordance with applicable law.

The buyer may be responsible for the direct cost of returning the artwork where they were properly informed of this before purchase, unless the artist has agreed otherwise.

Commissioned or personalised artwork

The statutory right to cancel may not apply to artwork that is genuinely made to the buyer's individual specifications or is clearly personalised.

This does not remove statutory rights relating to faulty, misdescribed or non-conforming goods.

Private sellers

Where an artist is not acting as a trader, consumer protection rights that apply specifically to contracts between traders and consumers may not apply.

8. Shipping & Delivery

Shipping methods, prices, destinations and delivery estimates are generally set by each individual artist.

Artists are responsible for:

packaging artwork securely;
providing accurate shipping charges;
dispatching orders within the stated timeframe;
providing tracking details where applicable;
handling shipping enquiries and delivery issues; and
completing customs documentation where required.

International buyers may be responsible for customs charges, import taxes, duties or other charges imposed in their destination country where applicable.

Delivery estimates are estimates rather than guarantees unless a guaranteed delivery arrangement has expressly been agreed.

9. Payments

Payments through Irish Artmart are processed using secure payment services, including Stripe and payment functionality integrated with WooCommerce.

Buyers do not need a separate Stripe account to purchase artwork using a supported card or payment method offered at checkout.

Irish Artmart does not store full credit or debit card details on its website.

Payment processing may also be subject to the terms and privacy policies of the relevant payment provider.

10. Artist Memberships

Artists must hold an eligible Irish Artmart artist membership to access vendor services.

Irish Artmart currently offers Starter, Basic, Premium and Premium Plus membership levels.

Payment Processing Fees on Artwork Sales

Marketplace commission and payment processing are separateA membership offering the artist 100% of the artwork sale means Irish Artmart takes 0% marketplace commission on that sale. It does not mean the customer's payment is processed without a fee.

Future fee policyFrom an effective date announced to artists in advance, the artist will bear the actual payment-processing fee charged by Stripe attributable to their sale. This applies to every artist membership level, including Premium and Premium Plus, irrespective of whether the artist receives the payout automatically through Stripe Connect or manually by bank transfer. Irish Artmart will not add a markup to the Stripe processing fee.

How the fee is calculatedThe deduction is based on Stripe's actual processing charge for the customer transaction, rather than an assumed flat rate. Stripe fees can vary according to card type, payment method, currency and other transaction characteristics. For an order involving a single artist, the actual transaction processing fee will be allocated to that artist. If one checkout includes items from more than one artist, the actual fee will be allocated between them in proportion to their respective gross order amounts, including shipping and applicable amounts processed, so that no artist is charged the entire fee for a shared checkout and the total recovered does not exceed the actual processing fee.

ShippingArtists remain entitled to 100% of the shipping charge assigned to their order, before any applicable payment-processing fee deduction. Because the customer's card payment may include shipping, the fee can also reflect that amount.

Artist settlementThe amount payable is the artist's artwork-sale entitlement, plus their shipping entitlement, less the applicable Stripe processing-fee allocation and any other separately disclosed, applicable deductions. The same fee treatment applies whether the artist has connected Stripe or is awaiting a manual bank transfer. No additional manual-payout administration fee is imposed under this policy.

Not yet activeThis new policy is not currently applied to payments. Until Irish Artmart announces an activation date and the payment system is configured and tested, Irish Artmart continues to absorb Stripe processing charges under its existing configuration. Fees will not be deducted retrospectively from sales completed before the effective date. Artists will receive advance notice of the change.

Where a subscription renews automatically, renewal information will be displayed through the subscription or account process.

Artists can manage or cancel subscriptions through their account or vendor dashboard where the relevant controls are available. Cancellation normally prevents the next renewal and does not automatically create a refund for a period already paid for, except where a refund or cancellation right is required by law.

11. Artist Payouts

Artists receiving automated marketplace payouts are required to connect an eligible Stripe account through the Irish Artmart vendor dashboard.

Irish Artmart operates a delayed payout process for marketplace orders. Payment to the artist may remain pending until the order has been fulfilled and the required shipping or fulfilment steps have been completed.

Payouts may be delayed where an order is disputed, cancelled, refunded, suspected of fraud or has not been properly fulfilled.

Artists are responsible for ensuring that their Stripe information and payout details remain accurate and operational.

An artist's share of a sale, together with the shipping charge payable to that artist, is the amount due before any applicable payment processing fee deduction. The amount actually transferred can therefore be lower when the artist-funded processing-fee policy described in section 10 becomes effective. Payment status and transfer records should not be treated as confirmation of settlement to an artist's bank account.

12. Make an Offer

Certain artworks may allow a buyer to submit an offer to the artist.

Submitting an offer does not itself complete a purchase. The artist may accept or reject the offer.

Where an offer is accepted, the buyer may receive a checkout link or other instructions allowing the artwork to be purchased at the agreed price.

Unless expressly stated otherwise, the artwork is not considered sold merely because an offer has been accepted. The purchase is completed through the applicable checkout and payment process.

13. Commission Requests

Irish Artmart may allow buyers to request bespoke or commissioned artwork directly from participating artists.

The artist and buyer are responsible for agreeing the important details of the commission, including the subject or scope, price, approximate completion timeframe and any other relevant specifications.

A commission may require a deposit before work begins and a final balance, together with any applicable shipping charge, before the completed artwork is dispatched.

Payment amounts and stages will be shown through the commission process where applicable.

Buyers and artists should keep commission-related communication and payments within the Irish Artmart system where that functionality is provided.

Because commissioned artwork may be created specifically to a buyer's individual requirements, statutory cancellation rights may differ from those applying to a standard artwork purchase. Statutory rights relating to faulty, misdescribed or non-conforming work remain unaffected.

14. Irish Artmart Auctions

Irish Artmart may run curated online auction events in which approved artworks are offered through competitive bidding.

For bidders

You must be eligible to enter into a binding contract.
You are responsible for checking the artwork details before bidding.
Bids must be genuine and must not be used to manipulate an auction.
You may not bid on your own artwork or arrange artificial bidding.
A valid winning bid creates an obligation to complete the purchase, subject to any mandatory legal rights that apply.

For artists

Auction submissions are subject to approval by Irish Artmart.
Listing information and reserve information must be accurate.
An approved auction artwork must remain available for the auction unless Irish Artmart agrees otherwise.
The artist is responsible for fulfilment once a successful auction purchase has been paid.

Following an auction, the successful bidder may receive an invoice or payment instructions. Artist settlement begins once buyer payment has been received and any applicable fulfilment requirements have been satisfied.

Irish Artmart may deduct the auction commission or other fee displayed for the relevant auction before calculating the artist's settlement.

Additional rules displayed for a particular auction form part of the terms of participation in that auction.

15. Artwork Listings, Pricing & Authenticity

Artwork pricing requirements

Artists are responsible for setting accurate prices for their work. For new standard artwork listings, Irish Artmart currently requires a Regular Price of at least €100 and no more than €5,000. Where a Sale Price is entered, it must be at least €50 and no more than €5,000 and comply with the applicable product pricing rules.

These minimums help maintain Irish Artmart's standards for original artwork and support fair pricing for artists. A minimum price is a listing requirement, not a guarantee of an artwork's quality, value or authenticity. Separate arrangements, including auctions, commissions, and other specialist sales, may have their own pricing rules where expressly stated.

Existing artwork listings

Artwork listed before the revised pricing requirements took effect may retain its existing lower price. Existing listings are not automatically repriced or removed solely because their previously accepted price falls below a new minimum. Artists may continue to edit other listing details without being required to increase an unchanged, previously accepted price. If an artist changes a price, the current applicable price requirements will apply to that change.

Artwork Quality & Authenticity

Irish Artmart is dedicated to genuine creative work. Artists must accurately represent the artwork offered, including its creator, medium, materials, condition, originality and whether it is an original artwork, print, reproduction or digital work. Images and descriptions must be clear, relevant and not materially misleading.

Mass-produced or AI-generated work must not be described or presented as an original handmade artwork where that description is untrue. Artists must not falsely claim authorship, originality, exclusivity or a production process that did not occur. Disclosure does not in itself guarantee that an artwork is suitable for listing on Irish Artmart.

When submitting new artwork for publication, artists are required to confirm that the listing meets Irish Artmart's Artwork Quality & Authenticity standards using the acknowledgement provided in the vendor dashboard. Drafts may be saved without making that confirmation. Existing listings are not automatically required to complete a new acknowledgement merely to edit their details.

Review and enforcement

Irish Artmart may request clarification or supporting information about a listing and may reject, return to draft, suspend or remove artwork that is misleading, infringes rights, omits required information or does not meet the marketplace's published standards. We aim to apply these standards reasonably and consistently, taking account of the context of each listing. A submitted acknowledgement does not constitute independent verification or approval by Irish Artmart.

Current technical listing requirements, including image, category, inventory and pricing settings, may also be displayed through the vendor dashboard or other artist guidance. Nothing in this section limits statutory rights or obligations under applicable law.

16. Copyright & Artist Content

Artists retain ownership of the copyright and other intellectual property rights they hold in their artwork and original content.

By uploading artwork images, descriptions, profile information or other content to Irish Artmart, the artist grants Irish Artmart a non-exclusive, worldwide, royalty-free licence to use, reproduce, resize, format, display and promote that content for the purposes of:

operating the Irish Artmart website and marketplace;
displaying the artist's store and listings;
promoting Irish Artmart and its artists;
sharing artwork through Irish Artmart social media and promotional channels; and
providing marketplace features and services.

Irish Artmart does not obtain ownership of the artist's copyright simply because artwork or images are uploaded to the platform.

Artists must have the legal right to upload and use all images, descriptions and other content they submit.

17. Prohibited Use

You must not use Irish Artmart to:

commit fraud or another unlawful act;
misrepresent the authorship, authenticity or ownership of artwork;
present AI-generated or mass-produced content falsely as original handmade artwork;
list stolen, counterfeit or infringing material;
infringe copyright, trademark or other intellectual property rights;
harass, threaten or abuse another user;
send spam or unsolicited bulk communications;
manipulate auctions, offers, reviews, prices or marketplace activity;
attempt to obtain unauthorised access to another account or Irish Artmart systems;
introduce malware, malicious code or automated attacks;
scrape or harvest personal information without lawful authority;
circumvent fees or payment processes legitimately due to Irish Artmart; or
use the platform in a way that materially damages or disrupts the service.

18. Taxes & Regulatory Responsibilities

Artists are responsible for understanding and meeting their own tax, VAT, accounting and business obligations arising from their activities on Irish Artmart.

Irish Artmart does not provide individual tax or accounting advice to artists.

Irish Artmart may request identity, tax, transaction or other information and may report information to tax authorities, regulators or other public bodies where required by law.

Buyers are responsible for any import duties or similar charges lawfully payable by them where artwork is delivered across borders.

19. Suspension & Termination

Irish Artmart may remove content, restrict features, suspend or terminate an account where reasonably necessary, including where:

these Terms have been materially breached;
fraudulent or unlawful activity is suspected;
fees legitimately due remain unpaid;
an artist repeatedly fails to fulfil orders;
content infringes third-party rights;
the security or integrity of the platform is at risk; or
Irish Artmart is legally required to take action.

Where appropriate and reasonably possible, we may provide notice or an opportunity to resolve an issue before permanent termination.

Artists may cancel their subscription or stop selling through Irish Artmart subject to outstanding orders, payments, subscriptions or other obligations.

20. Availability of the Website

We aim to keep Irish Artmart available and operating reliably, but uninterrupted access cannot be guaranteed.

The website or individual features may occasionally be unavailable because of maintenance, technical faults, security measures, third-party service interruptions or circumstances outside our reasonable control.

Where a technical issue materially affects an auction, transaction or other time-sensitive marketplace feature, Irish Artmart may take reasonable corrective action appropriate to the circumstances.

21. Marketplace Content & Third Parties

Much of the artwork information, biographies, descriptions, policies and other marketplace content is supplied directly by independent artists.

Artists are responsible for the accuracy of the information they provide.

Irish Artmart may review or moderate content but is not required to independently verify every statement made in every artist listing.

The website may also contain links to third-party websites or services. Irish Artmart is not responsible for the content, availability or privacy practices of independent third-party sites.

22. Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, and nothing in these Terms affects a consumer's mandatory statutory rights.

To the extent permitted by law, Irish Artmart is not responsible for losses caused solely by:

inaccurate information supplied by an independent artist;
an artist's failure to fulfil an order;
delivery delays or failures outside Irish Artmart's control;
third-party services outside Irish Artmart's reasonable control; or
use of the website contrary to these Terms.

Irish Artmart does not seek to exclude responsibility for its own obligations where liability cannot legally be excluded.

23. Privacy & Cookies

The use of personal information through Irish Artmart is also governed by our Privacy Policy.

24. Changes to These Terms

Irish Artmart may update these Terms & Conditions from time to time to reflect changes to the marketplace, our services, legal requirements or the way the platform operates.

The latest version will be published on this page with an updated revision date.

Where a change materially affects an ongoing paid service, we will provide additional notice where reasonably appropriate or legally required.

25. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

Nothing in these Terms deprives a consumer of any mandatory protection available to them under applicable consumer law.

Any dispute will be dealt with by the courts having jurisdiction under applicable law.

26. General

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

No waiver

A failure by Irish Artmart to enforce a provision on one occasion does not prevent us from enforcing it later.

No partnership or employment

An artist's use of Irish Artmart does not create an employment, partnership or agency relationship between the artist and Irish Artmart.

Statutory rights

Nothing in these Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted.
