Terms and Conditions
Last Updated: 18/7/2026
By purchasing artwork from Sarah Moloney Art ("the Artist", "I", "me", "my"), you agree to the following terms and conditions.
1. Products
I make every effort to accurately represent the colours and appearance of my artwork. However, colours may vary slightly due to differences in screen settings and device displays.
As many artworks are handmade originals, minor variations and characteristics are considered part of the artwork's unique nature.
2. Pricing and Payment
All prices are displayed in Euro (€) unless otherwise stated.
Payment must be received in full before an order is dispatched.
I reserve the right to change prices at any time without notice.
3. Shipping
Please refer to the Shipping Policy for information regarding processing times, delivery estimates, customs charges, VAT, import duties, and shipping responsibilities.
4. Returns and Cancellations
Original Artwork
Due to the unique nature of original artwork, returns are accepted only if the artwork arrives damaged or if there is a significant error in the order.
If your artwork arrives damaged, please contact me within 48 hours of delivery and provide photographs of the damage and packaging.
Prints and Custom Orders
Custom commissions, personalised artwork, and made-to-order items are non-refundable unless damaged or defective upon arrival.
EU Consumer Rights
Where applicable under Irish and EU consumer law, consumers may have statutory rights that cannot be excluded by these terms.
5. Damaged Items
If your order arrives damaged, please notify me within 48 hours of receipt and provide clear photographs. I will work with you to arrange a replacement, repair, or refund where appropriate.
6. Copyright and Intellectual Property
All artwork, images, photographs, designs, and content remain the copyright of Sarah Moloney Art unless otherwise agreed in writing.
The purchase of artwork does not transfer copyright ownership.
Artwork may not be reproduced, copied, distributed, scanned, modified, used commercially, or used to create derivative works without prior written permission.
7. Commissions
Commission work will be carried out according to specifications agreed between the client and the artist.
Deposits paid for commission work are non-refundable once work has commenced.
Minor revisions may be offered at the artist's discretion.
8. Limitation of Liability
To the fullest extent permitted by law, I shall not be liable for indirect, incidental, or consequential losses arising from the purchase or use of artwork.
My total liability shall not exceed the amount paid for the artwork.
9. Customs, VAT and Import Duties
Buyers are responsible for any customs duties, import taxes, VAT, handling charges, or other fees imposed by their country.
UK customers may be required to pay import VAT, customs duties, or handling charges before delivery. These charges are the responsibility of the buyer.
10. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Ireland.
Any disputes arising from these terms shall be subject to the jurisdiction of the Irish courts.
